Netprint.com is a website for creating, managing and ordering documents online.


3. Using the service and save facility

NETPRINT.COM SA reserves the right to unilaterally set the rules of use and to set service limits, such as, for example, determining the maximum memory space allowed for saving your images.

Bearing in mind the international nature of the Internet, the user agrees to comply with all the rules applicable in his/her country of domicile/residence.

6. Applicable law and court of jurisdiction

Any disagreement relating to the NETPRINT.COM SA website is governed by Belgian law. The courts and tribunals of the district of Brussels have sole jurisdiction.

In the event of litigation, a printed version of these general terms and conditions of use, and any addendum in electronic form, will be accepted in any judicial, extrajudicial or administrative procedure.



II. GENERAL TERMS AND CONDITIONS OF SALE FOR THE NETPRINT.COM WEBSITE



1. Scope of application

Netprint.com is a registered trade mark of NETPRINT.COM SA, whose head office is in Brussels, Belgium.

Contracts concluded with the website as intermediary are concluded directly with NETPRINT.COM SA.

These general terms and conditions of sale are applicable to all contracts concluded with the Netprint.com website as intermediary.

If the contract is concluded with a consumer, these general terms and conditions of sale are only applicable if the contract is a distance contract in the sense of Article 77, §1st, 1° of the law dated 14 July 1991 relating to commercial practices and to information and consumer protection. Consequently, these terms and conditions do not apply if, during the pre-contractual phase, the two parties physically meet one another.

3. Offer

Information detailing products or services that may be purchased on the Netprint.com website constitutes an offer for sale. Unless expressly stated otherwise, the offer is valid as long as it is present on the website.

However, NETPRINT.COM SA cannot be bound by an offer which, for reasons beyond their control, contains errors.


4. Contract formation


4.1. Steps to follow in order to conclude the contract

In order to conclude a sales contract, the buyer follows the following steps :

- Choosing a product
- Select your photo(s)
- Going trough the creation process (Assigning the photo(s), writing the caption(s),...). The creation process is different for every product (Photo prints, Photobooks, Cards, Gift items and Wall deco).
- Previewing the product
- Determining the quantity desired
- Previewing the products on order (shopping cart)
- Logging the billing address and shipping address
- Determining the method of delivery (if applicable)
- Viewing a summary of the order
- Obligation to accept the general terms and conditions of sale (accessible via a hyperlink) of NETPRINT.COM SA before confirming the order
- Payment online by credit card: the buyer selects the payment method. Any banking information provided by the buyer is transmitted directly to the company Ogone who manages and secures the online payment. NETPRINT.COM SA does not make a note of the payment information. A message advises the buyer that payment has been accepted or refused.
- Optional step "Registering" : registering as a Netprint.com user makes it possible for the user to access personal details (saved projects, photo collections, etc.) from any computer. The email address chosen will become the unique identifier for accessing the user's personal space on the Netprint.com server.


4.2. Moment of contract conclusion

The contract is considered concluded at the moment when the seller receives order confirmation from the buyer.


4.3. Sending confirmation

At the latest, at the moment of delivery, the seller sends the consumer confirmation of his/her order which contains the following elements: Netprint order number, Ogone payment number, date and time of transaction, total amount of order, name and description of product, quantity ordered, method of delivery, invoice address and delivery address.

The confirmation also contains a clause informing the consumer that there are no renunciation rights with this sale, the service subscribed to being the supply of a product made to the buyer's specifications and clearly personalized.

The confirmation is first of all displayed on the website at the end of order processing and is then sent to the buyer by email.

The confirmation received by email constitutes proof of contract for the buyer.


5. Electronic evidence

Within the framework of their relations, the parties accept electronic evidence, such as emails and recordings within computer systems.


6. Absence of the right to renounce the contract

The consumer cannot exercise his/her right to renounce his/her purchase, because his/her purchase refers to a product that is clearly personalized.


7. Payment

The buyer pays the price of his/her purchases using an electronic payment/funds transfer facility authorized by Ogone. The payment module is managed directly by the company Ogone, none of the information relating to payment is transmitted to NETPRINT.COM SA.

NETPRINT.COM SA therefore disclaims all liability relating to online payment.

After the payment process, the buyer receives a message of confirmation or, if there are any problems, a message inviting him/her to restart the payment procedure.


8. Delivery


8.1. Choice of method of delivery

The buyer specifies in his/her order the type of delivery desired.


8.2. Delivery period

NETPRINT.COM SA undertakes to start printing within 48 working hours.

NETPRINT.COM SA undertakes to warn the buyer should there be any potential delay to delivery beyond the company's control.

Except in the case of force majeure, if the delay exceeds the 30 day delivery period initially envisaged, the buyer will be able to renounce the sale at no expense and will be re-credited with the amount of his/her order.


9. Protection of intellectual property

The intellectual property rights for the website and its contents are owned by NETPRINT.COM SA or third parties. The sales contract concluded between NETPRINT.COM SA and the buyer does not grant the buyer the right to copy, reproduce, download, post, transmit or distribute any of the elements of the NETPRINT.COM SA website.


10. Privacy protection

The rules relating to upholding the legislation on the protection of personal data are described in the policy on personal data.


11. Applicable law and court of jurisdiction

Any disagreement relating to the NETPRINT.COM SA website is governed by Belgian law. The courts and tribunals of the district of Brussels have sole jurisdiction.
